FMLA Balance Discrepancy: How to Compare Your Leave Log With HR

If your employer says you have 37 FMLA hours left and your own record says 61, the first useful question is not “who is wrong?” It is “where do the calculations diverge?”

Five common sources of mismatch

1. Different normal workweek

If HR uses 40 hours but your normally scheduled workweek is different, the starting hourly equivalent may not match.

2. Different leave-year method

Calendar year and rolling 12-month calculations can produce different remaining balances on the same date.

3. Different amount charged for an absence

A partial-day entry may have been charged differently from what you expected.

4. Missing or duplicated entries

Portal histories are useful, but a duplicate, correction or retroactive designation can change totals.

5. Schedule changes

If your normal schedule changed, the correct calculation may require more context than a single static hours-per-week number.

Keep two columns: employer charge and independent charge

For each absence, record both values.

The goal is not to create a self-declared official balance. The goal is to identify which entry needs an explanation.

Save balance snapshots

Whenever the employer, HR system or third-party administrator gives you a balance, record:

  • date shown;
  • remaining hours or weeks;
  • source name;
  • screenshot/letter reference;
  • leave-year method if stated;
  • notes about adjustments.

A balance with no date is almost useless in a rolling system.

Ask for the calculation, not just the conclusion

A productive question is:

“Can you provide the dates and amounts charged to FMLA and the leave-year method used to calculate my current balance?”

That creates information you can compare with your own ledger.

Keep notices and certification timing beside the hours

A leave ledger is stronger when it includes process events too:

  • leave first requested;
  • eligibility notice;
  • certification requested;
  • certification supplied;
  • designation notice;
  • recertification request;
  • fitness-for-duty requirement;
  • balance statement.

Current DOL guidance generally uses five-business-day notice markers for eligibility/designation and at least 15 calendar days for requested medical certification, subject to the applicable circumstances.
