When an overpayment notice arrives, the strongest first step is not writing a long explanation. It is building a dated evidence file that can be checked month by month.

Core evidence checklist
The notice
Save the complete notice, including pages that explain:
- the total amount;
- the months involved;
- SSA’s stated reason;
- appeal or waiver instructions;
- repayment amount or withholding rate;
- dates printed on the notice.
Payment history
Create a month-by-month table showing what you received and, if available, what SSA says should have been paid.
A difference that looks small in one month can create a large total over a long period. Reconstructing the months lets you spot gaps or duplicated assumptions.
Change-report evidence
For every event SSA says affected payment, record:
- what changed;
- effective date;
- when you reported it;
- how you reported it;
- confirmation or receipt number;
- what happened afterward.
Examples include wage changes, work activity, living arrangements, marital status and resources for SSI.
Communications
Keep a dated log of:
- phone calls;
- office visits;
- uploaded documents;
- mailed forms;
- faxes;
- messages;
- promised follow-ups.
A note such as “called SSA sometime in May” is far weaker than “May 14, 10:25 a.m., local office, reported new employer, representative said wages were added.”
Financial-hardship records for a waiver or lower repayment rate
If affordability is relevant, organize current essential expenses rather than guessing from memory.
Typical categories include housing, utilities, food, medical costs, transportation, insurance and other necessary obligations.
Make the file self-explanatory
A good case packet should let another person understand the sequence without you narrating every page.
Use:
- one-page case summary;
- chronology;
- month-by-month calculation;
- evidence index;
- supporting documents in the same order as the index.
