Manifestation Determination Review: What Parents Should Bring and Track

A manifestation determination review is not just a meeting about the behavior incident. Under IDEA, the relevant group reviews information including the student’s IEP, teacher observations and relevant information provided by the parents.
That makes preparation a recordkeeping problem as much as a meeting problem.

The federal timing marker
IDEA requires the manifestation determination to occur within 10 school days of a decision to change the placement of a child with a disability because of a code-of-conduct violation.

The tracker treats that as a timing marker. It does not decide by itself whether a particular series of removals legally constitutes a change of placement.
What the team is deciding
The federal rule asks whether the conduct:
- was caused by, or had a direct and substantial relationship to, the child’s disability; or
- was the direct result of the LEA’s failure to implement the IEP.
That second question is why accommodation and service records can matter during discipline.

Build a one-page chronology first
Before collecting every document you own, make a short timeline:

That timeline makes the larger file navigable.
Parent information worth bringing
Depending on the situation, relevant information can include:
- current IEP and behavior plan;
- recent evaluation information;
- parent observations about triggers or disability-related behavior;
- accommodation implementation history;
- service delivery concerns;
- prior similar incidents;
- functional behavioral assessment information;
- behavior intervention plan history;
- school communication about support needs;
- records of informal removals or early pickups.
Do not bring material just because it exists. Bring it because it helps answer one of the questions the review must consider.
Track whether the IEP was implemented
If you believe a relevant support was not provided, document the specific support and date.
Weak:
The school never follows the IEP.
Stronger:
The IEP lists a scheduled check-in before third period. My log shows three confirmed dates in the two weeks before the incident when the check-in did not occur, including the incident date. I requested the school’s service/implementation record on [date].
That does not decide the outcome, but it gives the team a concrete implementation question.
Keep services during suspension visible
Record whether the student received:
- assignments;
- access to instruction;
- special education services;
- related services;
- communication about how IEP progress would continue.
IDEA includes service requirements in discipline situations, especially after cumulative removals reach 10 school days in the school year.
Questions to leave the meeting with answered
Before the meeting ends, try to know:
- what determination was made;
- what information the team relied on;
- whether the IEP implementation question was addressed;
- whether an FBA will be conducted or reviewed;
- whether the BIP will be created or modified;
- where the student will be educated next;
- what services will continue;
- what written notice or documentation you will receive.
Add those answers to the same chronology immediately after the meeting.

When to get local help
Manifestation determinations and disciplinary changes of placement are legal processes with fact-specific rules. If there is disagreement about placement, procedural rights or remedies, use the student’s procedural safeguards and qualified state/local advocacy or legal assistance rather than relying on a generic web tool.
